Terms of Service

Effective date: June 10, 2026

These Terms of Service ("Terms") govern your use of https://phase3live.com (the "Site"), operated by Phase 3 Concert Productions ("Phase 3 Live," "we," "us"). By using the Site, you agree to these Terms. If you do not agree, do not use the Site.

Use of the Site

We grant you a limited, non-exclusive, revocable license to access and use the Site for your personal, non-commercial purposes — learning about our services, requesting an estimate, and contacting us. You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorized access to the Site, its servers, or connected systems.
  • Scrape, copy, or republish Site content at scale without written permission.
  • Submit forms with false information or use automated tools to submit forms.
  • Interfere with the Site's operation or security features.

No Professional Advice; Estimates Are Not Binding Quotes

Content on this Site is general information about our services. It is not professional advice for your specific situation, and you should not rely on it as such. Prices, timelines, and descriptions shown on the Site, and any preliminary estimate we provide before inspecting the work, are informational only. An estimate is not a binding quote. Final pricing is confirmed in a written agreement or invoice after we have assessed the actual scope of work.

Service Estimates and Scheduling

  • Estimates are based on the information you provide. If conditions on site differ from what was described, the price and timeline may change, and we will tell you before proceeding.
  • Requesting an appointment through the Site is a request, not a confirmed booking. Your appointment is confirmed when we contact you to confirm it.
  • Scheduled work may be affected by weather, supplier delays, or emergencies. We will communicate changes as early as we can and reschedule promptly.
  • Specific warranty, payment, and cancellation terms for the work itself are set out in your service agreement or invoice, which controls over these Terms for that work.

Intellectual Property

The Site and its content — text, photos, graphics, logos, and design — are owned by Phase 3 Concert Productions or used under license, and are protected by copyright and trademark law. You may not reproduce, distribute, or create derivative works from Site content without our written permission, except for brief excerpts with attribution or as otherwise allowed by law. To report a copyright concern, see our DMCA Policy.

Your Submissions

When you submit information through the Site, you represent that it is accurate, that you have the right to share it, and that any phone number or email you provide belongs to you or you are authorized to use it. How we handle submitted information is described in our Privacy Policy.

Limitation of Liability

The Site is provided "as is" and "as available," without warranties of any kind, express or implied. To the fullest extent permitted by law, Phase 3 Concert Productions will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site, including lost profits, lost data, or business interruption — even if we have been advised of the possibility of such damages. Our total liability arising from your use of the Site will not exceed one hundred dollars ($100). This limitation applies to the Site only; liability for services we perform is governed by your service agreement. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

Indemnification

You agree to indemnify and hold harmless Phase 3 Concert Productions and its owners, employees, and agents from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.

Governing Law

These Terms are governed by the laws of the State of Oklahoma, without regard to its conflict of law rules. Any dispute arising from these Terms or your use of the Site will be brought in the state or federal courts located in Oklahoma, and you consent to their jurisdiction.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page. Your continued use of the Site after a change means you accept the updated Terms.
